Press Statement by the Embassy of the Islamic Republic of Iran

"On the occasion of “The fifth anniversary of the JCPOA

 

June 14th marks the 5th anniversary of one of the most remarkable achievements in international diplomacy. The signing of the nuclear deal known as the JCPOA between the Islamic Republic of Iran and the 5+1 together with the European Union was, undoubtedly, a milestone for international diplomacy and a great achievement for the promotion of multilateralism, securing the mutual interests of all parties involved in a long and breathtaking process of negotiations.

 

The unilateral withdrawal of the United States from a multilateral, comprehensive, workable and effective negotiated deal since May 8th 2018 has caused a fundamental blow not only to the deal itself but also to the high goal of multilateralism and beyond all, creating an environment of non-confidence to tackle international conflicts through peaceful means and settlements. As a result of this highly antagonistic development, Iran has essentially been deprived of any tangible benefits, despite complying with its commitments, primarily due to Europe's failures. With respect to the unlawful US administration’s position regarding the JCPOA, Iran has constantly reiterated that the illegal re-imposition of all U.S. sanctions is indeed in material breach of Resolution 2231, the most important purpose of which is to end sanctions. 

 

The Islamic Republic of Iran has regarded adherence to the JCPOA as a curtail commitment for achieving the collective interests and security of multilateral diplomacy.  On the contrary, we have regrettably witnessed how malign U.S. unilateralism has intently assaulted international cooperation and damaged internationally recognized agreements. This extremely unlawful approach by the current US administration is seriously undermining global peace and security to the extent that, since May 8th, 2018, the U.S. Government has persistently and astonishingly been persuading other states to join on violating the deal and the UNSC resolution 2231. Surprisingly, for the first time in the UN history, a permanent member of the Security Council is punishing law-abiding states for not violating a security Council resolution, which has assumingly been outlined to promote and facilitate the development of normal economic and commercial relations and cooperation with Iran.

The unlawful U.S. unilateral withdrawal from the JCPOA and the re-imposition of its sanctions entail the U.S. responsibility under the UNSCR 2231, UN Charter and applicable international law.

 

Since May 2018, the UN Secretary General, the remaining JCPOA parties, and many other members of the international community have called on Iran to address its concerns through the mechanisms established in the JCPOA. The European JCPOA parties requested Iran to wait for only a few weeks, allowing them to compensate for the losses incurred to Iran as a result of the re-imposed US sanctions. Acting in good faith, we refrained from applying the ‘remedy’ to enable the remaining JCPOA participants to make good on their promises. For a full year, we continued the full implementation of the JCPOA as verified by 15 consecutive IAEA reports. Unfortunately, the E3 response to our “strategic patience” has been quite disappointing that even the Instex mechanism has not yet become operational, while it is a rational expectation from the E3 countries to realize their historic responsibility and take a more constructive position prior to the total annihilation of all international diplomatic achievements by the current US administration. The international community must keep in mind that Iran will not be the only party to pay for the failures it has witnessed, but all parties involved must pay their shares.

 

It should be well noted that the Islamic republic of Iran has been under the most inhuman pressures for the fabricated PMD allegations regarding its peaceful nuclear activity, and it looks like the same scenario is being repeated again by the US and Israel.

 

The JCPOA can only be maintained by rejecting US unilateral and inhumane sanctions and countering the destructive moves of this administration and its allies and the realization of Iran's legitimate rights under the deal. Iran has fully complied with its commitments, and it is now up to the international community to support the JCPOA by taking practical steps. In this regard, the responsibility of European members of this deal is prominent and fundamental.
